HEALTH JOURNEY TERMS AND CONDITIONS

Welcome to Health Journey. These Terms and Conditions ("Terms") govern your access to and use of the Health Journey website, membership platform, applications, services, educational content, consultations, and any related products or services (collectively, the "Services").

By accessing or using our Services, submitting any registration or intake forms, or clicking to accept these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use our Services.

1. Eligibility and Account Registration

To access and use our Services, you must:

●      Be at least 18 years of age (or the legal age of majority in your jurisdiction) or have explicit authorization from a parent or legal guardian.

●      Provide accurate, truthful, and complete information across all intake forms, assessments, and profile setups.

●      Use the platform strictly for lawful purposes and in compliance with all applicable local, national, and international laws and regulations.

By submitting any registration form, health intake questionnaire, or assessment through our platform, you explicitly consent to these Terms and Conditions and our Privacy Policy. Health Journey reserves the right to suspend or terminate accounts or restrict access to services if false, misleading, or unauthorized information is provided.

2. Membership and Services Scope

Health Journey offers membership-based wellness and precision health services across operating territories, including The Bahamas, Curaçao, Sint Maarten, Aruba, and international markets. Depending on your selected plan, membership may include:

●      Personalized health and wellness assessments.

●      Preventive wellness programs and follow-up recommendations.

●      Access to virtual or in-person medical consultations.

●      Educational resources and digital health tools.

●      Coordination of laboratory and epigenetic testing.

●      Comprehensive health and wellness reports.

Membership benefits and service features may evolve over time as Health Journey improves its platform and service offerings.

3. Medical Disclaimer

Health Journey provides health education, wellness services, care coordination, and access to qualified healthcare professionals. Unless expressly stated otherwise in writing during a formal consultation with a licensed clinician, the information, reports, content, and materials provided through this platform are intended for educational and informational purposes only and should not be considered direct medical advice, diagnosis, or treatment.

Users should always seek advice from qualified healthcare professionals regarding specific medical conditions or clinical treatment plans.

3.1 Nature of Wellness and Epigenetic Reports

Health Journey's wellness and epigenetic reports, scores, and related materials are informational and educational tools intended solely to support well-being optimization. This technology has not been certified, and is not intended, as a tool for the diagnosis, treatment, monitoring, cure, or prevention of any disease or medical condition. Reports, marketing materials, and communications generated through or about the Services must not use, and Users may not represent the Services using, terms such as "diagnosis," "disease," "pathology," "clinical result," "cure," or any other term that could reasonably mislead a recipient into believing the reports constitute a medical or clinical determination.

Any use of the reports, or any public or private representation of them, that distorts their informational and non-clinical nature may result in a formal warning, suspension of platform access, or termination of membership, without prejudice to any other rights or remedies available to Health Journey.

4. No Emergency Services

HEALTH JOURNEY DOES NOT PROVIDE EMERGENCY MEDICAL SERVICES.

If you are experiencing a medical emergency, call your local emergency services immediately or go to the nearest hospital emergency department in your territory (e.g., The Bahamas, Curaçao, Sint Maarten, or Aruba). Do not rely on Health Journey digital platforms or support channels for urgent medical assistance.

5. User Responsibilities

Users agree to:

●      Provide truthful, complete, and updated personal and health information.

●      Maintain the strict confidentiality of their account credentials and login information.

●      Promptly notify Health Journey of any unauthorized account access or security breaches.

●      Use the platform responsibly and refrain from uploading malicious software, unauthorized code, or harmful content.

●      Respect all intellectual property rights associated with the Services.

Users are solely responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

6. Appointments and Consultations

Appointments and consultations may be conducted virtually or in person, depending on provider availability, clinical licensing, and local health regulations in the target territory. Users are responsible for arriving on time and providing any requested documentation prior to scheduled consultations. Health Journey reserves the right to reschedule appointments when necessary due to provider availability or operational constraints.

7. Laboratory, Epigenetic, and Cross-Border Logistics

Certain wellness services involve third-party laboratories or specialized external service providers. Health Journey coordinates these services but does not guarantee laboratory processing turnaround times, cross-border customs clearance, international biological sample transit times, shipping schedules, or the permanent availability of specific external providers across regional islands and territories (including The Bahamas, Curaçao, Sint Maarten, and Aruba). Laboratory findings and epigenetic assessments are intended to support wellness programs and should always be interpreted in coordination with qualified professionals.

7.1 Report Interpretation and Professional Responsibility

The correct interpretation of laboratory, epigenetic, and wellness reports requires appropriate technical and professional training. Where a report is reviewed with, or delivered through, a coach, consultant, or affiliated professional, that professional is solely responsible for ensuring the information is communicated accurately and is never presented as a substitute for a clinical evaluation. Incomplete reading, partial extrapolation, or the direct association of report results with a medical or diagnostic condition constitutes a misuse of the report.

Health Journey assumes no liability for the misinterpretation, misuse, or unauthorized onward communication of report data by Users or by any professional interacting with a User outside Health Journey's direct clinical channels.

8. Payment, Multi-Currency, and Automatic Renewal

Certain Services and recurring membership plans require payment. By purchasing a membership or service, you agree to:

●      Pay all applicable fees in United States Dollars (USD) or approved local currencies, including applicable local sales taxes, turnover taxes (e.g., TOT in Sint Maarten, BBO/BAVV/BAVP in Aruba, OB in Curaçao, VAT in The Bahamas), or import duties.

●      Provide valid, updated, and authorized payment information.

●      Authorize automatic recurring charges (e.g., monthly or annually) to your designated payment method for active subscription plans.

Prices are subject to change; however, price modifications will not apply retroactively to active subscription periods already completed.

9. Refunds and Cancellation Policy

You may cancel your membership subscription at any time through your account settings or by submitting a written request to our support team at results@healthjourney.guide at least five (5) business days prior to your next billing cycle.

Refunds are governed strictly by our Refund Policy. Due to operational, clinical, cross-border shipping, and regulatory requirements, fees paid for completed medical consultations, performed laboratory/epigenetic processing, customized health reports, or digital materials already delivered are strictly non-refundable.

10. Intellectual Property

All platform content—including logos, branding, videos, educational materials, documents, graphics, images, reports, software code, and text—is the exclusive property of Health Journey or its licensors and is protected by applicable intellectual property and copyright laws. Users may not reproduce, distribute, modify, create derivative works of, or commercially exploit any content without prior written permission from Health Journey.

10.1 Restrictions on Use of Brand, Marketing Materials, and Resale of Reports

Use of the Health Journey name, logo, isotypes, trade dress, or any confusingly similar derivation, on social media, independent websites, professional profiles, packaging, or promotional material of any kind is prohibited without Health Journey's prior written authorization. This restriction is intended to prevent the creation of unauthorized profiles, materials, or communications that could mislead the public as to their origin, endorsement, or validity.

Users, affiliated professionals, and partners may not resell, sublicense, or otherwise commercially distribute Health Journey reports, assessments, or educational materials to third parties, nor offer the Services through unauthorized marketplaces or platforms, without Health Journey's prior written consent. Any customization of report covers or client-facing materials may only use branding elements expressly approved by Health Journey; altering the content, results, or logos contained in a Health Journey-generated document is prohibited.

Breach of this Section may result in suspension or termination of platform access, cancellation of any applicable professional or affiliate agreement, and pursuit of any available legal remedies for trademark infringement, unfair competition, or misuse of corporate image.

11. Privacy, Data Protection, and Cross-Border Transfers

Your use of our Services is governed by our Privacy Policy. Health Journey complies with applicable data protection legislation, including international privacy standards and local data transfer regulations governing the collection, cross-border transfer, storage, and processing of health-related and personal data across jurisdictions (including The Bahamas Data Protection Act, Curaçao Personal Data Protection Ordinance, Aruba National Ordinance on Personal Data Protection, and Sint Maarten regulations).

12. Third-Party Services and Integrations

Our platform integrates with third-party service providers, including payment processors, communications platforms, scheduling tools, support desk software, external laboratories, and cloud storage providers. Health Journey is not responsible for the independent privacy policies, terms, or operational practices of third-party providers.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Health Journey, its officers, directors, employees, contractors, and partners shall not be liable for:

Delays or interruptions caused by external laboratories, customs authorities, courier delays between island jurisdictions, cloud platforms, or events outside our reasonable control.

 

Nothing in these Terms limits liability where such limitation is prohibited by mandatory local consumer protection law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Health Journey, its affiliates, officers, directors, employees, contractors, and healthcare partners from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from your misuse of the Services or violation of these Terms.

15. Suspension and Termination

Health Journey reserves the right to suspend or terminate your account or access to the Services at any time if:

●      These Terms or associated policies are violated.

●      Fraudulent or unauthorized activity is suspected.

●      Required profile or health information is intentionally falsified.

●      Continued access presents security, operational, or legal risks.

16. Changes to the Terms

Health Journey may modify these Terms at any time. Material modifications will be published on the website or communicated via email. Continued access to or use of the Services following the publication of revised Terms constitutes full acceptance of the updated document.

17. Jurisdiction Specific Provisions & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the primary jurisdiction where Health Journey is legally established, without regard to conflict of law principles.

For users accessing Services within The Bahamas, Curaçao, Sint Maarten, or Aruba, mandatory local consumer protection laws, health regulatory requirements, and local statutory rights shall apply where applicable and strictly required by mandatory law. In the event of a legal dispute or claim involving operations within these territories, the parties agree to seek resolution through amicable negotiations before submitting to competent courts or designated arbitration panels in the applicable jurisdiction.

17.1 Online Dispute Resolution and Complaint Channels

 

Before initiating any formal claim, Users are encouraged to first contact Health Journey's Legal & Compliance Department using the details in Section 22 so that the matter may be addressed informally. Where the User's territory maintains a governmental or regional online dispute resolution (ODR) or consumer-complaint platform, Health Journey will cooperate in good faith with any such mechanism to the extent required by mandatory local law, without prejudice to the dispute resolution process described in this Section.

18. Right of Withdrawal / Cooling-Off Period

Where required by mandatory local consumer protection law, Users who purchase a membership or service as consumers (i.e., not for a professional or business purpose) may have the right to withdraw from an order within fourteen (14) calendar days of purchase, by written notice to results@healthjourney.guide, provided that no medical consultation has been performed, no laboratory or epigenetic sample has been processed, and no personalized report or digital material has yet been delivered.

Because Health Journey's core Services are personalized, time-sensitive, and often performed or delivered within the withdrawal period at the User's request, the right of withdrawal does not apply once performance of a consultation, laboratory or epigenetic processing, or delivery of a customized report or digital material has begun, consistent with the non-refundable items described in Section 9. Health Journey will confirm before service delivery where an order may result in loss of the right of withdrawal.

19. Force Majeure

Health Journey shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond its reasonable control, including but not limited to natural disasters, hurricanes, pandemics or public health emergencies, acts of government, customs or border delays, courier or carrier disruptions between island jurisdictions, power or telecommunications outages, or failures of third-party laboratories, cloud providers, or payment processors. Performance of the affected obligations will resume as soon as reasonably practicable once the relevant event has ceased.

20. Severability

If any provision of these Terms is held by a competent court or authority to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if it cannot be so modified, severed from these Terms. The remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy and any Refund Policy or service-specific agreement expressly referenced herein, constitute the entire agreement between the User and Health Journey with respect to the Services, and supersede all prior or contemporaneous understandings, whether written or oral, regarding the same subject matter.

23. Compliance With Colombian Law And Provision Of Services In Colombia

 

When users undergo epigenetic testing, sample collection, medical consultations, health assessments, wellness services, or any other health-related activity within the territory of the Republic of Colombia, Health Journey will endeavor to ensure that such activities are provided directly or through professionals, laboratories, healthcare institutions, and other providers that are duly authorized, licensed, accredited, or otherwise legally permitted to provide such services under applicable Colombian law. In particular, the processing of personal, genetic, biometric, and health-related information will be subject to applicable Colombian personal data protection laws, including Law 1581 of 2012 and its implementing regulations, recognizing that health-related information constitutes sensitive personal data and therefore requires enhanced protection, appropriate authorization, security measures, and confidentiality. Where applicable to the provision of healthcare services, such services shall be provided in accordance with Colombian healthcare regulations, including Resolution 3100 of 2019 and any subsequent regulations that amend, supplement, or replace it, as well as applicable requirements relating to medical records, confidentiality, professional secrecy, informed consent, and the lawful practice of healthcare professions. Medical consultations and other activities that constitute the practice of medicine shall be performed exclusively by healthcare professionals legally authorized to practice in Colombia and, where required by law, within duly authorized and licensed healthcare facilities or services. Health Journey does not represent or warrant that an epigenetic test, wellness report, health assessment, or educational content, by itself, constitutes a medical diagnosis, treatment, or clinical act, except where expressly provided by a healthcare professional who is legally authorized to practice in Colombia and within the applicable legal and professional framework. In all cases, Health Journey will implement reasonable measures for the security, confidentiality, access control, retention, and processing of personal and health information and will obtain the authorizations and consents required for the collection, use, storage, analysis, disclosure, and, where applicable, national or international transfer of such information. Where third parties are involved, including laboratories, healthcare professionals, healthcare institutions, technology platforms, cloud service providers, or data processing providers, Health Journey will endeavor to ensure that such third parties comply with applicable laws and with contractual obligations relating to confidentiality, security, and data protection. In the event of any conflict between these Terms and Conditions and a mandatory provision of Colombian law, the applicable mandatory legal provision shall prevail.
